How I can Register a Rent Deed in Pakistan?

In Pakistan, every person who offers their immovable property for temporary occupation or let out to a tenant is required to execute a tenancy agreement (also commonly known as a “Rent Deed”). Rent laws are covered under a provincial domain, which means that the provincial government makes laws pertaining to rent matters. In Punjab, the Government of Punjab has promulgated THE PUNJAB RENTAL PREMISES ACT 2009, which covers and regulates all affairs pertaining to rent.

Rent Deed must be in writing and registered?

As required by section 5 of the Punjab Rental Premises Act 2009, every rent/tenancy agreement must be in writing and registered with the Rent Registrar under the Registration Act, 1908. The Rent Registrar will then enter the particulars of the rent/tenancy in a register, affix his official seal on the tenancy agreement, retain a copy thereof, and return the original agreement to the landlord. The tenancy agreement entered into between a landlord and tenant must be registered with the Rent Registrar in order to be valid. Any other agreements made between the two parties regarding the property must also be presented to the Rent Registrar for approval.

STEP 2: PREPARE CHILD ADOPTION CONTRACT

What particulars are required to be described in the Rent Agreement?

The Rent Agreement or Tenancy Agreement for the purpose of registration must contain all necessary particulars of both the Landlord and the Tenant, amongst other things. The particulars which are necessary and required to be detailed in the Rent Agreement are as follows:
- The names and contact details of both the Landlord and the Tenant
- The address of the property being rented
- The rental amount and frequency of payment
- The length of the tenancy agreement

STEP 3: OBTAIN GUARDIANSHIP CERTIFICATE FROM COURT

Who is a Rent Controller?

Rent Controller is a Sub-Registrar of the area in which property is located. Sub-Registrar registers Rent Agreement under Section 17(d) of the Registration Act, 1908 and Section 107 of the Transfer of Property Act, 1882

What are the Disadvantages for not Registering Rent Deed or Tenancy Agreement?

Any disputes in relation to rent are to be handled and decided by the Rent Tribunal - which is a court that specializes in dealing with such cases. According to Section 9 of the Punjab Rental Premises Act 2009, any applications related to a rent agreement will not be accepted unless the agreement itself is registered with the Rent Controller. If the application is submitted by the Tenant, their case will not be looked into unless they also deposit 5% of the annual rent into the Government Treasury. The Pakistani government requires that landlords wishing to file for rent control must first deposit 10% of the annual rent with the Treasury.
